In a significant development for the construction equipment industry, the European Union institutions have reached a provisional agreement on the regulation harmonising road circulation requirements for NRMM.

The European Commission presented the proposal for this regulation on March 30, 2023, marking a crucial step in completing the EU legal framework.

The key discussions during the political trialogue mainly focused on the mechanism of delegated acts (DA) versus implementing acts (IA). While the European Parliament and the European Commission favoured the use of delegated acts, the Council supported implementing acts. 

Industry stakeholders, including CECE and other sister associations, have emphasised the critical nature of approving this legislation, while stressing the significance of using delegated acts. 

While specific details of the political agreement are yet to be released, several aspects have been confirmed:

  • Delegated acts will be employed in Art. 15.

  • Member States will retain the authority to prohibit the use of fully autonomous machinery under Article 4.

  • Category U is included, although there is no mandatory requirement for subcategories.

  • Member States can restrict the circulation of machinery if excessive dimensions or mass pose risks to infrastructure, such as bridges or viaducts.

CECE remains vigilant, closely monitoring the regulatory process and advocating for crucial points still under discussion, such as the recitals.
