  • The EU has published Regulation (EU) 2025/14 on the approval and market surveillance of non-road mobile machinery (NRMM) for public roads.

  • The regulation will come into force on 28 January 2025 and be applicable from 29 January 2028.

  • It applies to self-propelled machinery intended for public roads, excluding towed machinery and machinery with speeds below 6 km/h or above 40 km/h.

  • A small series threshold of 70 units has been confirmed, with detailed provisions for EU individual approval in Chapter IX.

  • Delegated and implementing acts will outline and establish technical requirements and threshold values for NRMM.

  • Transitional provisions allow Member States to apply national type-approval laws until 29 January 2036, with manufacturers having multiple compliance options during this period.

We are pleased to announce that the long-awaited Regulation (EU) 2025/14 on the approval and market surveillance of non-road mobile machinery (NRMM) circulating on public roads was officially published in the EU Official Journal on 8th January.

This important regulation aligns closely with the provisional agreement published back in March 2024 and introduces crucial technical and administrative requirements for EU type-approval and market placement of new NRMM for public roads.

Key highlights include:

  • Entry into Force: 28 January 2025.

  • Entry into Application: 29 January 2028.

  • Scope:

    • Applies exclusively to self-propelled machinery intended to circulate on public roads.

    • Excludes towed machinery equipment and mobile machinery with a design speed below 6 km/h or exceeding 40 km/h.

  • Small Series Threshold: A limit of 70 units has been confirmed.

  • EU Individual Approval: Detailed provisions are included in Chapter IX. 

  • Delegated and Implementing Acts:

    • A delegated act will outline the methodology for calculating threshold values (Article 5) and address technical requirements for NRMM on public roads (Article 16). 

    • An implementing act will establish specific threshold values, ensuring oversight by Member States. 

  • Transitional Provisions: Between 29 January 2028 and 29 January 2036, Member States may continue applying national type-approval laws for NRMM. Manufacturers can choose EU type-approval, EU individual approval, or compliance with national law during this period.

This regulation, together with the recent publication of the study on technical requirements for the road approval of NRMM, marks a strong step forward. According to Article 50(7), the European Commission will need to issue delegated acts outlining the specific technical requirements for road approval before 29 January 2027.
